Nintendo Files for an Injunction And $17,500 In Damages from Streamer Over Piracy Issues

As you know, Nintendo is one of the most rigorous and vehement companies when it comes to the protection of its intellectual properties. People who are caught infringing Nintendo’s copyrighted properties will generally be faced with a court battle, as Nintendo does not shy away from taking people to court.
There have been numerous instances around the world where people got caught up in court battles against Nintendo, and based on the most recent story, the company has filed a lawsuit against an online game streamer.
Namely, Nintendo is seeking an injunction and damages from a game streamer because he promoted pirated content and piracy during his streams.
In this particular case, Nintendo of America filed a lawsuit against streamer Jesse Keighin – known under the online alias Every Game Guru – asking for an immediate injunction, as well as $17,500 in damages. Why?
Well, Nintendo of America claims that Keighin has “repeatedly streamed pirated and emulated” Switch games in his videos and that he was also using social media to promote Switch emulators, which Nintendo also considers illegal.
Nintendo sent complaints to Keighin, but he has seemingly not responded to any of them, and now they’ve filed a lawsuit. They claim that Keighin streamed several different pirated titles:
Regardless, Nintendo has decided to sue him for just one game (Paper Mario: The Thousand-Year Door), despite claiming that he had illegally obtained and streamed all these games “at least fifty times in the last two years” and that all of that happened before the games had been officially released. He also, according to the lawsuit, promoted emulators and ROMs.
The damages for the one game stand at $10,000, while the remaining $7,500 are related to the promotion of emulators and “circumvention of technological protection measures and trafficking in circumvention technology.”
On top of that, there’s the injunction, which would effectively kill Keighin’s current streaming career, as well as the demand to destroy “all circumvention devices” in his possession currently.
An official decision in this case has yet to be made, but we are definitely going to be following up on this case, so be sure to keep following us for all the updates!
